What is an Australia Partner / Spouse visa?

A spouse visa or partner visa for Australia allows the spouses or de facto partners of Australian citizens /permanent residents to stay in Australia as permanent residents.

Who is eligible to apply for an Australia Partner / Spouse visa?

• The person needs to be married to an Australian citizen, Australian permanent resident or eligible New Zealand citizen, or
• The person is engaged to or is Fiancé of an Australian citizen, Australian permanent resident or eligible New Zealand citizen, or
• The individual is a De facto partner of an Australian citizen, Australian permanent resident or eligible New Zealand citizen.

What are the Eligibility Requirements for an Australian Partner / Spouse Visa?

Below are the key eligibility requirements for applying for an Australian Spouse Visa

• Age – Australian law requires an individual to be aged 18 or above to be married. Hence if you are applying for a spouse visa or partner visa the applicant needs to be 18 years or older while making the application.​ A marriage with an individual of less than 18 years of age or a de-facto partner aged less than 18 years is not eligible for the visa.
• Relationship – One needs to be a spouse or a de facto partner of an Australian citizen or permanent resident, or eligible New Zealand citizen. The person may be eligible for the visa in case the relationship breaks down after the application is lodged.​
• De-Facto relationship – You must be in a de facto relationship with your partner, that is living together for a period of 12 months immediately before making the application.
• Sponsor – You need to have a partner in Australia aged above 18 years who will sponsor you.​
• Health and Character – You need to meet the health and character parameters as specified in Australia’s immigration policy.
• Debts – You should not have any unpaid debts pending to the Australian government.​

Who Can Apply for Australia Partner / Spouse Visa? What are the types of Partner Visas?

A future spouse or de facto partner of an Australian citizen, eligible New Zealand citizen, or Australian Permanent Resident visa holder can apply for an Australia spouse visa. To be able to make an application, the partner or spouse is required to sponsor the spouse visa application for at least two years. The partner visa/spouse visa can be applied in subclasses 801, 820, 100 and 309.

• The spouse visa (subclass 820 or 309) is an Australia partner visa that is offered on a temporary (provisional) basis. You can work and live temporarily in Australia on this visa, and gain permanent residence under subclass 801 or subclass 100
• You must be onshore in Australia, while applying for subclass 801 and subclass 820. On the other hand, you must be outside Australia while applying for subclass 309 and subclass 100.
• If you are in a relationship and want to stay in that relationship, then you may be eligible for a permanent partner visa. This visa is granted for two years and can be renewed if both parties are still together.
• You can apply for both permanent and temporary visas for one partner at the same time. The Department of Home Affairs will process the application for the partner visa in two stages. The permanent visa is processed two years post the approval of temporary visa.
