What Is a Subclass 461 Visa?

The Subclass 461 visa is for family members who aren’t from New Zealand but are related to New Zealand citizens who must have or be able to get a Special Category Visa (Subclass 444) and live in Australia.

This visa lets you:

  • Call Australia home for up to 5 years
  • Work and hit the books without limits
  • Come and go from Australia as you please
  • Ask to stay longer every five years as long as you still meet the requirements

You might still be able to renew even if your New Zealand citizen family member isn’t applying with you or no longer has their visa.

Who Can Get the New Zealand Family Visa (Subclass 461)?

You could be eligible for the Subclass 461 visa if you:

  • Aren’t a citizen of New Zealand or Australia
  • Belong to the family unit (a partner, kid or dependent) of a New Zealand citizen
  • Have a family member who’s a New Zealand citizen and holds or can get a Subclass 444 visa
  • Are in Australia or outside the country when you apply
  • Pass Australia’s health and character checks

You can apply without traveling with your Kiwi family member, and you have options to renew the visa even if your family situation changes in certain cases.

How Long Can You Stay on a Subclass 461 Visa?

This visa lasts five years and you can renew it. Many people who apply choose to stay in Australia for a long time. They do this by renewing their 461 visa or looking into ways to become permanent residents.

At Ezy Immigration, we can help you look at your options for the long run. We can guide you through partner visas, Skilled Migration, and ways to get permanent residency while in Australia. We’ll make sure you always follow visa rules.

Bringing Your Family to Australia When You Have a Subclass 461 Visa

Do you already have a 461 visa? You can also bring your family members, like your partner or kids, to Australia. You can do this by adding them to your application or through a visa for later arrivals.

We’ll walk you through the paperwork and rules to qualify kids and partners so your family can stay with you.

Can I Work in Australia on a Subclass 461 Visa?

Yes – this visa has a big plus: you can work without limits. You’re allowed to work for any company, in any job, with no restrictions. If you’re a pro, have special skills, or want a casual job, the 461 visa lets you work while living with your family in Australia.

This works great for couples when one is from New Zealand and the other wants to help pay the bills, go to school, or get job experience in Australia.

What Happens if My Relationship Ends?

Even if your relationship with the New Zealand citizen ends, you might still be able to renew the visa under certain conditions. This depends on how long you had the visa, whether you had kids together, and other factors.

Ezy Immigration can look at your case and help you figure out if you can apply again on your own or if another visa might work better for you.
