What Is the Onshore Partner Visa (Subclass 820/801)?

The Onshore Partner Visa has two stages. It starts with a temporary visa (Subclass 820). After you wait and go through another assessment, it leads to a permanent visa (Subclass 801). This visa lets spouses and de facto partners of Australian citizens permanent residents, or eligible New Zealand citizens live in Australia.

 

After you get your Subclass 820, you can stay in Australia , work as much as you want, go to school, and use Medicare. In about two years (if you’re still together), you can apply for the Subclass 801 visa, which gives you permanent residency.

Who Can Apply?

You need to be in Australia when you apply. Your relationship must be either:

 

  • A legal marriage that Australia recognizes, or
  • A de facto relationship that’s lasted at least 12 months (unless you’ve registered your relationship with an Australian state or territory)

 

Your partner who sponsors you must be an Australian citizen permanent resident, or an eligible New Zealand citizen.
