What Is the Onshore Partner Visa (Subclass 820/801)?
The Onshore Partner Visa has two stages. It starts with a temporary visa (Subclass 820). After you wait and go through another assessment, it leads to a permanent visa (Subclass 801). This visa lets spouses and de facto partners of Australian citizens permanent residents, or eligible New Zealand citizens live in Australia.
After you get your Subclass 820, you can stay in Australia , work as much as you want, go to school, and use Medicare. In about two years (if you’re still together), you can apply for the Subclass 801 visa, which gives you permanent residency.
Who Can Apply?
You need to be in Australia when you apply. Your relationship must be either:
- A legal marriage that Australia recognizes, or
- A de facto relationship that’s lasted at least 12 months (unless you’ve registered your relationship with an Australian state or territory)
Your partner who sponsors you must be an Australian citizen permanent resident, or an eligible New Zealand citizen.
Ezy Immigration helps you check if you qualify, collect strong proof of your real relationship, and make sure you meet all the rules – because the small things count in partner visa applications.
Main Perks of Subclass 820/801 Visa
When you have the Subclass 820 visa, you can:
- Live in Australia with your partner
- Work and study as much as you want
- Get Medicare
- Come and go from Australia as you please
After you move to the Subclass 801 permanent visa, you get:
- Full rights as an Australian permanent resident
- Use of government help and services
- A way to become an Australian citizen
With your permanent partner visa, you can plan a long-term life in Australia — with the ability to do what you want, feel safe, and not worry about the future.
How Long Does It Take?
Partner visas go through two stages of assessment. The time it takes can change depending on your situation, but here’s a general idea:
- Subclass 820 (temporary): 6–28 months
- Subclass 801 (permanent): 6–12 months after you’re eligible (2 years from when you lodge your 820)
At Ezy Immigration, our migration agents help you look ahead, get your paperwork in order, and steer clear of hold-ups that could affect your plans.
Proof You'll Need to Show Your Relationship is Real
The Department of Home Affairs needs strong evidence that your relationship is real and ongoing. Proof includes:
- Joint money commitments
- Shared house duties
- Social recognition of your relationship
- Plans for the future as a pair
We assist you in organizing and showcasing your evidence in a professional manner, which boosts your chances of visa approval. If you’re not sure what evidence counts or how much you should provide, our team can walk you through the process.
Can Same-Sex Couples Apply?
Yes. Australia accepts same-sex relationships and marriages. You can apply like any other couple if you meet the general requirements for a partner visa and can prove your relationship is real.
Already Married Overseas?
If you tied the knot with your partner in another country and Australian law recognizes that marriage as valid, you can apply for the onshore partner visa — even if you just arrived in Australia. Get in touch with us to make sure your documents are translated and accepted.
